Important: these General Terms and Conditions exclusively govern the relationship between EcoRide Wallonie and the customer who reserves or uses the equipment. Relationships with partner accommodations are governed by separate agreements.
ARTICLE 1 – Purpose and scope
These General Terms and Conditions of Sale and Rental (hereinafter referred to as the "GTC") define the rights and obligations of EcoRide Wallonie and its customers in the context of the reservation and rental of electric mountain bikes, accessories, and associated services.
They apply to any reservation made with EcoRide Wallonie, via the website or by any other means accepted by Eco Ride Wallonie.
By confirming their reservation, the customer acknowledges having read these GTC, having had the opportunity to keep them, and accepts them without reservation.

ARTICLE 2 – Identification of the Lessor

In these GTC, EcoRide Wallonie is referred to as the "Lessor."
ARTICLE 3 – Definitions and equipment offered
The "Tenant" refers to the person who makes the reservation and enters into the contract with the Lessor. They are also responsible, within the limits provided by law, for ensuring compliance with these GTC by other users included in their reservation.
The "equipment" includes, depending on the reservation:
- one or more electric mountain bikes;
- a lock and its key;
- a helmet;
- a GPS containing pre-recorded routes, when reserved;
- a repair kit;
- a charger for multi-day rentals;
- any other accessory mentioned in the reservation confirmation.
The equipment remains the exclusive property of the Lessor at all times. The Renter may not sell it, lend it to a person not included in the reservation, sublet it, modify it, disassemble it, or have it repaired without prior agreement from the Lessor, except for simple interventions expressly authorized.
ARTICLE 4 – Reservation and partner code
Reservations are primarily made through the EcoRide Wallonie website. The Renter selects
in particular the date, time, duration, number of mountain bikes, desired sizes, options, and the location of
availability.

When the Renter stays at a partner accommodation, they use the partner code provided
by their host. This code allows for the identification of the place of stay and to organize the availability of the
equipment. It does not create any rental contract between the Renter and the accommodation: the contract is concluded
exclusively with Eco Ride Wallonie.
People not staying in partner accommodation can submit a request. The Lessor examines it based on location, the number of requested mountain bikes, availability, and organizational constraints. A request is only accepted after written confirmation from the Lessor.
The reservation becomes final after :
- the complete and accurate entry of the requested information ;
- the acceptance of these general terms and conditions ;
- the payment of the amount due ;
- the validation of the bank imprint or deposit, when required ;
- the confirmation sent by EcoRide Wallonie.
The Lessor may refuse or cancel a reservation before its execution in case of incorrect information, incomplete payment, logistical impossibility, unavailability of equipment, security risk, or reasonable suspicion of fraud. The financial consequences are determined in accordance with these general terms and conditions and applicable mandatory rules.
The Lessor makes every effort to respect the requested sizes. In case of exceptional unavailability, a close size may be offered to the Tenant, who remains free to accept it.
ARTICLE 5 – Rates, payment, and obvious error
The applicable rates are those displayed on the website or communicated by the Lessor at the time of booking. They are expressed in euros, all taxes included, unless otherwise stated.
The rates of a confirmed reservation are not modified, except for changes requested by the Tenant or correction of an obvious pricing error.
In case of encoding or display errors that are clearly incompatible with the price normally charged, the Lessor informs the Tenant before the execution of the reservation. The Tenant can then confirm the reservation at the correct price or obtain cancellation and a full refund of the amounts already paid.
In case of payment refusal, incompleteness, or non-receipt within the indicated timeframe, the reservation may be canceled. Bank fees directly caused by an error attributable to the Tenant may be charged to them upon proof.
The rates of a confirmed reservation are not modified, except for changes requested by the Tenant or correction of an obvious pricing error.

ARTICLE 6 – Deposit and deductible
A deposit is required for any rental. It is set at €250 per mountain bike, with a maximum of €750 per reservation starting from four mountain bikes.
The deposit is made by bank imprint or by any other means accepted by the Lessor. It is not automatically cashed and serves as a guarantee for any amounts that may be due following the rental.
In case of breakage, deterioration, loss, or theft, a deductible of €300 per affected mountain bike may remain the responsibility of the Tenant, subject to the conditions provided in these general terms and conditions and the insurance coverage actually applicable.
The deposit is made by bank imprint or by any other means accepted by the Lessor. It is not automatically cashed and serves as a guarantee for any amounts that may be due following the rental.

ARTICLE 7 – Commitments of Eco Ride Wallonia
The Lessor commits to:
- provide well-maintained and checked equipment before each rental;
- prepare the batteries and accessories according to the reserved package;
- communicate the necessary practical information before departure;
- provide the equipment inspection report and the equipment condition validation form;
- make the user guide available to the Tenant;
- to diligently address reported incidents, claims, and the release of the deposit.
These commitments do not include assistance, troubleshooting, or repatriation services during the rental, unless a specific commitment is confirmed in writing.
ARTICLE 8 – Provision of Equipment
The equipment is made available at the location, date, and time indicated in the booking confirmation. In a partner accommodation, it may be set up before the start time, in the space agreed upon with the accommodation.
The Tenant receives in particular:
- the summary of the reservation;
- the location of the equipment;
- the identifiers of the relevant mountain bikes;
- the access code to the box containing the padlock keys, when this system is used;
- the equipment control report;
- the link to validate the condition of the equipment;
- the link to the user guide.
The access code is intended for the Tenant and the users included in their reservation. It must be kept confidential and cannot be communicated to anyone outside the rental. The rental begins at the scheduled time, regardless of when the Tenant decides to pick up the equipment or start their outing.
ARTICLE 9 – Validation of the Condition of the Equipment
Before each rental, Eco Ride Wallonia prepares a control report describing the apparent condition of the equipment. This report may include photographs, the identifiers of the mountain bikes, the mileage, accessories, and useful observations.
Before starting their outing, the Renter checks the equipment provided, reviews the report, and completes the validation of the equipment's condition, notably by electronic signature. They can add any comments or report an anomaly in the designated form.
Any anomaly that may affect safety must be reported immediately. The concerned mountain bike cannot be used without instruction from the Lessor.
In the absence of comments made before use, the equipment is presumed to have been received in the apparent condition described in the report, without prejudice to the possibility for the Renter to provide contrary evidence.

ARTICLE 10 – Users, fitness, and equipment
Each user must know how to ride a bike independently and be able to brake, maneuver, and control an electric mountain bike. They choose a size, a formula, and a route suitable for their body type, experience, and physical condition.
The Renter is responsible for the information provided regarding other users and ensures that they communicate the applicable instructions.
Minors use the equipment under the responsibility and supervision of an adult. Eco Ride Wallonie may refuse use when it appears manifestly unsuitable or dangerous due to the user's size, age, fitness, or behavior.
The provided helmet must be worn during use. Each user should also prepare appropriate clothing, shoes, and protection against weather conditions, as well as a charged phone, water, and, depending on the duration, something to eat.
The Renter is responsible for the information provided regarding other users and ensures that they communicate the applicable instructions.
Minors use the equipment under the responsibility and supervision of an adult. Eco Ride Wallonie may refuse use when it appears manifestly unsuitable or dangerous due to the user's size, age, fitness, or behavior.
The provided helmet must be worn during use. Each user should also prepare appropriate clothing, shoes, and protection against weather conditions, as well as a charged phone, water, and, depending on the duration, something to eat.
ARTICLE 11 – Conditions of use
The equipment must be used with caution, as part of normal recreational use and in accordance with the user guide.
The Renter and each user agree in particular to:
- comply with the Highway Code and local regulations;
- adapt the speed and level of assistance to the terrain, visibility, and their control;
- respect authorized paths, private properties, natural areas, and temporary prohibitions;
- monitor the battery level and adjust the route accordingly;
- stop using in case of defect, abnormal noise, significant shock, or safety issue;
- secure the mountain bikes to a solid fixed point with the locks provided at each stop;
- carefully keep the keys, GPS, chargers, and accessories.
The following are particularly prohibited:
- subletting and lending to a person not included in the reservation;
- competition, significant jumps, bike parks, extreme descents, and any practice clearly unsuitable for the equipment;
- transporting a second person on a mountain bike not designed for that purpose;
- modification, disassembly, or repair by a third party without agreement;
- immersion of the mountain bike, battery, or electrical components;
- use under the influence of alcohol, drugs, or substances impairing driving;
- abandoning the equipment without reasonable supervision.
ARTICLE 12 – GPS, routes, battery, and charging
When a GPS is reserved, the routes are pre-recorded in the device. The GPS and the routes provide navigation assistance: they do not relieve the user from staying attentive, obeying the signage, and adapting their route to the circumstances encountered on the ground.
The Lessor does not guarantee the permanent passability of the routes. Their condition may be altered by weather, construction, hunts, fallen trees, closures, traffic modifications, or other events beyond their control.
The battery life depends notably on the terrain, the weight of the user, the level of assistance, the temperature, the wind, the terrain, and the way of riding. No fixed battery life can be guaranteed.
For rentals of several days, the charger is provided. Only this charger may be used. It is prohibited to charge the equipment in a damp place, to cover the charger, to disassemble the battery, or to handle the electrical components.
Any immersion, significant fall, deformation, unusual odor, abnormal heat release, or other signs that may affect the battery must be reported immediately. The mountain bike should no longer be used or charged until instructed by the Lessor.
The Lessor does not guarantee the permanent passability of the routes. Their condition may be altered by weather, construction, hunts, fallen trees, closures, traffic modifications, or other events beyond their control.
The battery life depends notably on the terrain, the weight of the user, the level of assistance, the temperature, the wind, the terrain, and the way of riding. No fixed battery life can be guaranteed.
For rentals of several days, the charger is provided. Only this charger may be used. It is prohibited to charge the equipment in a damp place, to cover the charger, to disassemble the battery, or to handle the electrical components.
Any immersion, significant fall, deformation, unusual odor, abnormal heat release, or other signs that may affect the battery must be reported immediately. The mountain bike should no longer be used or charged until instructed by the Lessor.
ARTICLE 13 – Breakdown, incident, and lack of assistance
Eco Ride Wallonia does not provide any assistance service, on-site troubleshooting, user recovery, or repatriation during the rental period.
In case of breakdown, accident, fall, flat tire, abnormal noise, or incident likely to affect safety, the user stops the mountain bike and informs Eco Ride Wallonie as soon as possible. The report allows the Lessor to indicate the precautions to be taken, but does not create any obligation for on-site intervention.
The Tenant organizes and bears their return, the transport of people, and any taxi, transport, or accommodation costs related to the interruption of the outing, unless these costs result directly from a proven failure of the Lessor to meet their legal obligations.
No replacement mountain bike is guaranteed during the rental. However, the Lessor may propose a solution depending on the circumstances, their availability, and the origin of the problem, without this possibility constituting a permanent contractual commitment.
Flat tires resulting from normal use are not charged. A simple repair can be carried out with the provided kit only if the user has the necessary skills. No repair by a third party can be ordered at the Lessor's expense without prior agreement, except in urgent need for safety.
Any accident that may have damaged the mountain bike must be reported, even if the equipment still appears usable.
ARTICLE 14 – Theft, loss, damage, and normal wear and tear
The Tenant is responsible for the equipment from the time it is made available until its complete return. In case of theft or disappearance, they must immediately inform the Lessor, file a complaint with the police as soon as possible, and provide a copy of the report.
When the mountain bike was properly secured using the provided lock to a solid fixed point and the other instructions were followed, the financial consequences are determined in accordance with Article 6 and, if applicable, the conditions of the applicable insurance.
When theft, loss, or damage results from gross negligence, including an unsecured mountain bike, a forgotten key, prohibited use, or a failure to report, actual costs may be claimed from the Tenant within the limits allowed by law.
Normal wear and tear is not charged. The following are considered as normal use: minor surface marks, reasonable dust or mud, normal wear of tires, brakes, and drivetrain, as well as a flat tire not attributable to clearly inappropriate use.
Charges may be applied with justification: damages related to a fall or impact, deterioration resulting from inappropriate use, loss or breakage of an accessory, GPS, charger, or keys, as well as damages not reported at the time of return validation.

ARTICLE 15 – Return and validation of equipment return
The Tenant returns the equipment to the place, on the date, and at the time specified.
Before leaving the premises, he:
- returns the mountain bikes to the indicated location;
- properly locks each mountain bike with its lock;
- returns the keys to the key box and closes it;
- returns the GPS, charger, and all accessories;
- completes the equipment return validation form;
- reports any incident, fall, damage, loss, or useful remark.
The equipment remains the responsibility of the Renter until these steps are fully completed.
After the return, the Lessor checks the equipment and compares, if necessary, the reports, photographs, and information recorded before and after the rental.

ARTICLE 16 – Delay and cleaning
The Renter respects the return time. They inform the Lessor as soon as they anticipate a delay. Any delay may result in a charge of €10 for each commenced 30-minute period. Notifying the Lessor does not automatically waive these fees.
When the delay prevents a subsequent reservation or causes demonstrable additional harm, the Lessor may request additional compensation proportional to the actual damage suffered.

ARTICLE 17 – Cancellation, modification, and right of withdrawal
For commercial purposes, the Lessor may offer a postponement, subject to availability. The postponement is never automatic, must be confirmed in writing, and can only be granted once, unless otherwise agreed.
A modification of date, duration, number of mountain bikes, sizes, options, or place of availability is subject to availability and confirmation by the Lessor. Any additional charge must be paid before validation. A price reduction may result, depending on the circumstances and timing, in a refund, a credit, or no refund in accordance with the cancellation conditions.
The reservation concerns a leisure activity provided on a specific date or during a specified period. The Tenant is informed that they do not benefit from the legal withdrawal period of fourteen days applicable to certain contracts concluded at a distance. The cancellation conditions of this article remain applicable.
Rain, cold, overcast weather, or simply uncomfortable conditions do not constitute a reason for a refund or free cancellation. Mountain bikes can be used in the rain, provided that appropriate clothing is worn and conditions do not present any particular danger.

Any additional charge must be paid before validation. A price reduction may result, depending on the circumstances and timing, in a refund, a credit, or no refund in accordance with the cancellation conditions.

The Tenant is informed that they do not benefit from the legal withdrawal period of fourteen days applicable to certain contracts concluded at a distance. The Lessor may cancel, postpone, or adjust a reservation when circumstances make the rental impossible, dangerous, or unreasonably difficult, particularly in the case of dangerous weather, official alerts, breakdowns, accidents, theft, unforeseen unavailability, inability to access the location, major logistical problems, or force majeure.
Depending on the circumstances, the Lessor offers a reasonable solution: replacement of equipment, adjustment of the reservation, postponement, or total or partial refund of the service not provided.
The Lessor is not responsible for indirect costs such as accommodation, transportation, replacement activity, or loss of time, unless otherwise provided by mandatory legal provisions or proven fault of the Lessor.
Depending on the circumstances, the Lessor offers a reasonable solution: replacement of equipment, adjustment of the reservation, postponement, or total or partial refund of the service not provided.
The Lessor is not responsible for indirect costs such as accommodation, transportation, replacement activity, or loss of time, unless otherwise provided by mandatory legal provisions or proven fault of the Lessor.
ARTICLE 19 – Responsibilities and insurance
The Tenant is responsible for their conduct, the choice of route, and compliance with applicable rules.
They are liable for any damage they cause to the equipment, other users, third parties, or the property of others when it results from their behavior, inaccurate information, or non-compliance with these General Terms and Conditions.
The Tenant declares that they have liability insurance that may cover damages caused to third parties and is invited to verify the extent of their coverage, particularly for the use of an electric mountain bike. Individual accident insurance is recommended.
Eco Ride Wallonia commits to providing well-maintained and controlled equipment. Its liability remains governed by Belgian law and cannot be excluded in cases of intentional fault, gross negligence, or failure to comply with a mandatory legal obligation.
Subject to this reservation, the Lessor is not liable for damages resulting notably from improper use, non-compliance with instructions, inappropriate driving, insufficient physical condition, inappropriate route choice, an external event, or an interruption of the outing not resulting from a failure of the Lessor.
They are liable for any damage they cause to the equipment, other users, third parties, or the property of others when it results from their behavior, inaccurate information, or non-compliance with these General Terms and Conditions.
The Tenant declares that they have liability insurance that may cover damages caused to third parties and is invited to verify the extent of their coverage, particularly for the use of an electric mountain bike. Individual accident insurance is recommended.

Eco Ride Wallonia processes the data necessary for managing requests, reservations, payments, deposits, communications, equipment checks, validations before and after rental, billing, incidents, and claims.
Detailed information regarding the purposes, legal bases, recipients, retention periods, and rights of individuals can be found in the Privacy Policy available on the site.
Photographs of the equipment taken before or after the rental serve to document its condition, manage the deposit, examine damage, or handle a dispute. When they only represent the equipment and locations necessary for the check, they are not used for advertising purposes. Any publication of an identifiable image of a client for commercial purposes requires an appropriate basis and, when required, their consent.
Reservation data, confirmations, electronic signatures, timestamps, control reports, validations of the condition and return of the equipment, photographs, and electronic exchanges may be used as evidence, without depriving the parties of the possibility of providing contrary evidence.

ARTICLE 21 – Claims and mediation
Any claim must be addressed in writing as soon as possible to ecoridewallonie@gmail.com, mentioning the name of the Tenant, the reference, and the date of the reservation, as well as a precise description of the issue and any relevant supporting documents.

If no solution is found, the consumer may contact the Consumer Mediation Service or any other competent alternative dispute resolution entity, according to the applicable admissibility conditions.

ARTICLE 22 – Applicable law and final provisions
These General Terms and Conditions are governed by Belgian law.
In the absence of an amicable solution, the competent courts are determined in accordance with the applicable legal rules. No clause in these General Terms and Conditions deprives a consumer of the mandatory protection to which they are entitled.
If a provision is declared null or unenforceable, the other provisions remain in effect. The concerned provision is, to the extent possible, replaced or interpreted in accordance with the lawful objective it pursued.
The Lessor may modify these General Terms and Conditions for the future. The applicable version is the one accepted at the time of booking.
